Autumn in New York: Pay Transparency Legislation 2022 Roundup

“You’ve Got Mail” is one of my favorite movies, and I look forward to the fall season each year. But in 2022, if you are a New York employee, you have other reasons to look forward to the fall. 

New York City, the City of Ithaca, and Westchester County all have pay transparency laws going into effect this fall. Additionally, the state of New York is waiting for Governor Kathy Hochul to sign its pay transparency legislation into law, which was passed earlier this summer by the New York Legislature.  

Let’s break down some of the important things you need to know about each upcoming pay equity law. 

Ithaca, New York – Effective September 1, 2022 

On May 4, 2022, the City of Ithaca followed New York City in enacting an almost identical pay transparency ordinance. In Ithaca, if you have four (4) or more employees, then you must post the minimum and maximum salary compensation for any job posting, including roles for promotion or transfer. The ordinance is silent on whether employers must comply with this ordinance only if the job is required to be performed in Ithaca or if the job posting can be performed anywhere in the country with the possibility of the job being performed in Ithaca. 

New York City, New York- Effective November 1, 2022 

Earlier this year, New York City passed a pay transparency ordinance requiring all employers with four (4) or more employees to disclose the salary range of any job posting or promotion opportunity. We have been tracking this piece of legislation, and more information on it can be found here. 

Westchester County, New York – Effective November 6, 2022 

Westchester County also followed suit in passing pay transparency legislation. Any employers posting for a job that must or can be performed in Westchester County must post the “lowest to highest salary the employer in good faith believes at the time of the posting would pay” for that role. Westchester did clarify some of the ambiguities in the New York City and Ithaca pay transparency laws by specifically defining a “job posting.”  

New York State – Pending 

On June 3, 2022, the New York State legislature passed a state-wide pay transparency legislation. The proposed bill, Senate Bill 9427, which still needs to be signed by Governor Hochul, requires employers to post a salary range and job description in each job advertisement. While we expect Governor Hochul to sign this bill, we will be monitoring this bill for its effective date.
