A special counsel is a lawyer who is brought in to assist a state or federal jurisdiction during a specific case, when that institution feels that it is in the public interest. This traditionally occurs when the prosecutor or attorney general feels that there is the potential for the public to feel that a conflict of interest may exist. The role that a special counsel plays in the case he or she is hired to work on varies from situation to situation. The special counsel may be asked to take the lead role in gathering evidence and broadening an investigation. The special counsel could find that his or her unique expertise is required in using difficult evidence to construct a manageable case in a concise and organized manner. The special counsel may simply serve at the evidentiary level to interview principals and analyze data.
A special counsel is first and foremost an attorney, and thus will have a law degree and be certified by the appropriate bar examination group. In most cases, a special counsel is also chosen for his or her own reputation and area of expertise. Often, the special counsel is selected from retired practicing attorneys, university professors, and retired politicians.
